Dealer operators of mobile operators, internet service providers and TV platform companies are trying to sell subscriptions to citizens by introducing themselves as company representatives. It tries to gain new subscribers through its dealership by calling citizens with many different phone numbers, especially 0850 numbers. Citizens, on the other hand, believe that this is called directly by the operator company or ISP company, and they trust these calls and can accept the offered campaigns. This situation creates various grievances.

At the same time, making these calls frequently (to the extent of harassment from time to time) is one of the issues that consumers complain about. The Information Technologies and Communications Authority (BTK) took action for these calls.

The “Draft Procedures and Principles for Making a Confirmation Call Before the Establishment of a New Individual Subscription for Internet/TV and Fixed Telephone Services” prepared by the BTK was published on the institution’s website and opened to public opinion. Determining that new subscriptions are established through calls made through various numbers without the demand of consumers and that this causes many consumer grievances, BTK aims to prevent this victimization and to protect consumer rights and interests.

According to the regulation, operators will first confirm that they are registered with the Commercial Electronic Message Management System (İYS) in order to promote the new individual subscription facility and campaign. If the citizens do not want to receive a call, they will be able to cancel the call permission through the IYS system.

Companies will get confirmation by calling the customer

If the customer is reached by the dealerships and the customer accepts the new subscription offer, the customer will be called by the internet, TV or the corporate number of the operator company to which the subscription will be created and confirmation will be obtained before the subscription agreement regarding the service to be provided.

The type of service to be offered to consumers in the confirmation search, the total fee to be paid including the device purchase price, connection, activation, installation and similar fees, the average monthly fee to be paid, the data rates announced in internet access services, the duration of the commitment for registered subscriptions and the payment in case of termination. All fees will be notified. After that, consumers will be informed as “Do you approve the start of the new subscription process”. If the approval is not given, the subscription will not be started.

Within the scope of the regulation, the burden of proof in all transactions will belong to the dealer operators. If the enterprises do not fulfill their obligations, an administrative fine will be applied within the scope of the provisions of the ICTA Administrative Sanctions Regulation.
