Tesla, one of the most important shareholders of the electric car industry, came to the fore with a lawsuit that included important claims. A group of Tesla owners in the US claimed that their Model S and Model X vehicles had reduced battery capacity after automatically installed software updates.

It was reported that the range of the vehicles decreased by up to 20% with the decrease in battery capacity. On the other hand, some users also reported that they experienced malfunctions in the battery. Vehicle owners who wanted to seek their rights naturally took the road to the court.

Tesla’s automatic updates ‘violate consumer rights’

In the lawsuit filed in U.S. District Court in San Francisco, vehicle owners stated that Tesla vehicles had “protected computers.” In the lawsuit, it was stated that the automatic updates violated consumer rights under the Computer Fraud and Abuse Act.

The reason for the violation in question was shared by Attorney Hagens Berman, representing Tesla owners, as follows:

“Tesla owners and renters are at the mercy of their car’s maker, and Tesla applies unauthorized software updates every time their car connects to Wi-Fi.”

Some Tesla owners took help from third-party people to delete the updates, announced that they paid a fee of 500-700 dollars. Lawyers for the plaintiffs shared that Tesla refused to provide refunds to Model S and Model X owners and renters who experienced reduced battery capacity after the software update.

Similar complaints were recently settled in favor of Tesla owners:

In July 2021, Tesla experienced an issue with software updates that temporarily lowered the maximum battery voltage. After the issue affected 1,743 Tesla Model S, the company paid a $625 fee to each Tesla owner affected by the bug.
