Istanbul 19th Criminal Court of First Instance signed a decision that concerns millions of citizens. Examining the dispute between Murat Faruk Özbay, the former Chairman of the Fair Play Council of the National Olympic Committee of Turkey, and the company that Özbay rented a car for years, the court sentenced Özbay to prison for not delivering the rented vehicle on time. The decision, which even the prosecutor objected, aroused concern in the citizens.

According to the information obtained, Murat Faruk Özbay rented a car for 2 years from a car rental company that he had an agreement with. However, 7-8 months after the rental, the payments started to be delayed. Acting on this, the company made a warning request that both the overdue debt and the debt subject to the contract be paid in full, and that the car should be delivered immediately. Faruk Özbay, who paid 8 thousand 906 liras and the remaining part of the contract, 52 thousand 923 liras, said that the vehicle was not in Istanbul and that he would deliver it when he arrived in Istanbul. The rental company, which did not like this statement, decided to file a criminal complaint this time.

Convicted of breach of trust due to service

The company, which applied to the Istanbul Chief Public Prosecutor’s Office, claimed that Murat Faruk Özbay committed the crimes of breach of trust, abuse of security and fraud. The prosecutor and Özbay’s lawyer argued that there was no criminal element in this regard. However, the court concluded that Özbay abused trust. Deciding to impose a 1 year prison sentence and an administrative fine of 5 thousand TL, the court reduced the prison sentence to 3 months and 10 days due to the lack of a criminal record and the attitude at the hearing. Leaving the verdict statement behind, the court decided that Özbay should be subject to supervision for 5 years.

Murat Faruk Özbay, who made a statement on the subject, said, “There was a financial problem in our company in the future. Three times, there were 15-20 days of sagging in monthly payments. We talked to the company. We said that there was no bad intention, we were an old customer. They wanted the vehicle to be delivered. At that time, the vehicle was outside of Istanbul. We asked them to wait for a while, and when the vehicle arrived, we delivered it.” The decision shocked us. This decision concerns everyone who rents a car or house. The verdict reveals that anyone who does not deliver the vehicle or vacate the house on time could face such a penalty. Both we and the trial prosecutor objected to the decision. However, the relevant heavy penal court rejected it. Thus, the decision was finalized. ” said.
