In a news we shared with you in the past months, we talked about a law published in the Official Gazette. This law, which rewrites all the rules in the e-commerce sector, was published in the Official Gazette on July 7, 2022. Today, there has been a new development regarding the Law No. 7416 Amending the Law on the Regulation of Electronic Commerce. The Ministry of Commerce has officially published the regulation on how this law will be implemented.

The Regulation on Electronic Commerce Tool Service Providers and Electronic Commerce Service Providers in today’s issue of the Official Gazette explains one by one what should be done about the law that will start to be implemented as of January 1, 2023. The regulation, which consists of nine sections, directly concerns e-commerce platforms and people and companies engaged in e-commerce.

What does the regulation cover?

The regulation, which concerns e-commerce platforms and merchants engaged in e-commerce, makes statements in every category, from information to be given to the consumer, to license application. Thus, it is explained how to comply with the law that rewrites the rules of e-commerce and what to do.

Matters included in the Regulation on Electronic Commerce Intermediary Service Providers and Electronic Commerce Service Providers:

  • Information and order processes
  • Measures to be taken regarding illegal content and unfair commercial practices
  • What to do in copyright disputes
  • Brokerage agreements
  • Obligations of both e-commerce connoisseurs and platforms
  • Applications related to advertising and discount budgets
  • How the electronic commerce license process to be implemented as of January 1, 2025 will work

All e-commerce platforms and e-commerce connoisseurs who do not want to go against the Law No. 7416 should examine the issues in the regulation one by one and correct the deficiencies they see in themselves. Otherwise, complaints made after January 1, 2023 may face criminal penalties.
