Hermès Awaits Court Order for MetaBirkin NFTs
Luxury fashion brand Hermès is seeking a federal court to block sales of NFTs based on the popular Birkin bag, according to Reuters.
Last month, a New York jury ruled that digital artist Mason Rothschild infringed on Hermès’ intellectual property by promoting and selling “MetaBirkin” NFTs based on Birkin bags. Rothschild was ordered to pay 133,000 dollars in compensation.
He said that in Hermès’ file reached by Reuters, Rothschild claimed that he continued to promote NFTs despite the decision. The fashion company wants the federal court to intervene and order Rothschild to not only stop selling digital assets, but also hand over the NFTs he still owns to Hermès.
The court’s decision in favor of Hermès in February was held to set an important and potentially precedent, as it questioned whether NFTs were art or commodities.
