Ripple lawsuit enters critical phase

The legal battle between the SEC and Ripple has been contentious for nearly 2.5 years. In the latest developments, the court rejected the SEC’s request to seal the Hinman Papers. This document contains what William Hinman, a former SEC executive, said about Ethereum in 2018. Hinman made statements on this date that ETH is not a security.

The SEC later compelled Hinman to say that the speech was solely his opinion. It also required Ripple to sign an affidavit stating that there was no guidance to undermine its lack of fair warning defense.

However, Judge Netburn ruled that unlike the SEC, it was not within the privilege of speaking and negotiating process.
