It was alleged that e-Nabız was “sold” to Qatar

The lawsuit details revealed by T24 included a great detail in the tension between the two developer companies. It was claimed that the infrastructure of the e-Pulse application, which includes the data of all citizens, was sold to Qatar.

Interesting claims have been made today about e-Pulse, which was published in 2015 and allows citizens to follow all their health information. Bilbest, the first developer of e-Nabız, filed a lawsuit against another developer company, Tiga, for selling the infrastructure of the e-Nabız application to Qatar “as if it were its own property”.

In the details revealed by T24, it was stated that both companies were separately related to two Deputy Ministers of Health. Bilbest was founded by the wife of Deputy Minister Sabahattin Aydın, while it was claimed that Tiga was close to Deputy Minister Şuayipİlker.

Bilbest’s lawsuit, which includes the details of “sold to Qatar”:

Bilbest filed a lawsuit against Tiga and the Ministry. In this case, it was justified that Tiga violated its intellectual property rights by selling its e-Nabız infrastructure to Qatar. In the petition submitted to the court, it was stated that the two basic infrastructure systems that make up e-Nabız were developed by Bilbest, and the usage rights were transferred to the Ministry of Health.

It was stated that Tiga, which undertakes the maintenance, repair and update works of the application, turned e-Nabız into a commercial product by using the coding data obtained during the studies. It was requested that the profits of Tiga from this trade be determined by the court and paid to Bilbest.

IMPORTANT NOTE: The lawsuit in question does not involve the sale of e-Nabız data, but the sale of e-Nabız application infrastructure. Therefore, at least at this stage, we can underline that there is no question of the citizens’ data falling into the hands of Qatar.

Tiga, on the other hand, argued that it redesigned the application from scratch:

Tiga, in her response to the court, claimed that Bilbest did not respond to the needs, and that they had written from scratch upon the order of the Ministry of Health.

The Ministry of Health also joined the case:

In the petition sent to the court, the Ministry of Health emphasized that e-Nabız was created from scratch in 2017 and stated that this renewal was carried out under the leadership of Deputy Minister First. Let us remind you again that it is claimed that the first is related to the Tiga company.

The Ministry argued that the intellectual property of the product, which emerged as a result of the renewal in 2017, belongs to Tiga. He also requested the court to conduct the case in secret.

Bilbest opposed the Ministry:

Responding to the Ministry’s response, Bilbest stated that there was “voluntary litigation” between Tiga and the Ministry of Health. He also stated that in the reply presented by the Ministry, there were praises about Deputy Minister Mr. First and the reason for this could not be understood. Those accolades were countered as follows:

“The defendant Ministry of Health, believing that a general practitioner (Dr. Şuayipİlker) who does not have any informatics training or certificate, has designed, led and described numerous large informatics projects step by step, submitted a petition for an answer and claimed that the intellectual property rights of the work belonged to him.”

It is not known what process the case is at today. On the other hand, the truth of the claim that e-Nabız, which is the most interesting detail, was sold to Qatar, remains a mystery.
