Days before the start of the visa exam period in universities, a post was made that concerns many students and reveals the fact that many of them are not aware of it. Attorney Emre Burak Onat, who has a master’s degree in Tax Law, shared the answer given by the judiciary in 2020 to the question of whether students are obliged to follow the exam date change announcement in his post on LinkedIn.

Attorney Emre Burak Onat, who took note of the exam date announced at first, prepared for the day when the exam was announced. But he later learned that the exam was held on a previous day, that is, the date had changed. The announcement announcing the change of the exam date was announced on the school’s website and it was stated that he had to “follow the announcements”.

The decision to fail because he could not take the exam was cancelled:

Onat stated with the petition that he was present up to the top levels of the school on the first day of the exam announced with the petition, that he was not informed of the change, that information about possible changes was not included, and that he was not obliged to follow the website. But Onat’s petitions did not yield any results.

Onay, who was considered unsuccessful in her course because she could not take the exam, filed a lawsuit when she could not get any results from the school. Ankara 11th Administrative Court concluded the lawsuit in favor of Onat. It was decided to cancel Onat’s ‘unsuccessful’ process. The decision became final after passing the appeal examination.

In the court decision shared by Onat, it was stated that changes can only be made in the proceedings announced by the university if there is a reasonable justification, and it is necessary for the candidates to be informed of this change through current and legitimate communication methods.

Article 41 of the University’s Education and Training Regulations, titled ‘Notifications and Announcements’, stated that all kinds of notifications and announcements to the students would be made by sending them to the e-mail address provided by the university or in the official records. The student was only obliged to monitor the messages sent to this e-mail address.
