Yuga Labs Justified in Summary Court Judgment
A California judge was upheld in a partial summary ruling in cases brought against the popular Bored Ape Yacht Club (BAYC) NFT collection owned by Yuga Labs.
On the other side of the lawsuit, Ryder Ripps and Jeremy Cahen were the duo behind the NFT collection, which used BAYC-like marketing materials, posing similar to Bored Apes. However, the court ruled that the collection was being sold using BAYC brands without Yuga Labs’ permission.
Additionally, it decided it was “in a way that would cause confusion”, confusing consumers who wanted to purchase a genuine BAYC NFT with similar product appearance or track their value with token tracking tools. In addition, the court ruled that the defendants’ use of BAYC trademarks was neither fair use nor artistic expression, but was intended to mislead, as the collection’s project was successful. The court also ruled that the domain names used by the defendants could create confusion. Although Yuga Labs sought $200,000 in damages for the cyber invasion, the court rejected this claim.
