According to defense attorney James K. Filan, seven decisions are currently pending in the Ripple SEC case. The following decisions are underlined; First, Magistrate Netburn’s decision regarding the SEC’s claim that all of Hinman’s emails were protected by attorney-client privilege. Second, appeal against Judge Netburn’s DPP decision
Third, the SEC takes action to force it to respond to or change its response to certain requests for admission (RFA). Fourth, the attorney’s fee request for Metz’s supplemental report. Fifth, the motion for an amicus briefing to join the motion to exclude expert testimony “Daubert’s challenges.” Sixth, the motion on the exclusion of expert testimony and, finally, the motions on summary judgment.

- About Ripple defendants’ motion to compel the SEC to respond to certain admission requests: SEC’s opposition to Ripple’s enforcement action will be made no later than June 2, and Ripple defendants’ response will be June 13, 2022.
- Attorney’s fee claim based on supplementary Metz report: A joint response from both parties is expected by May 27.
- On May 21, CryptoLaw founder John Deaton made a call to take part in an anticipated challenge to an expert who claims to know the motivations of XRP holders when purchasing XRP. petitioned. The SEC’s objection to this motion is due by June 7, and the response to the objection is by June 10, 2022.
